لما كان الثابت بالأوراق أن الجريمة التي دين بها الطاعن وهي جريمة القتل الخطأ المعاقب عليها بالمادة 238/2،1 من قانون العقوبات ، وهي ليست من ضمن الجرائم المنصوص عليها في المادتين 3 ، 10 من قانون الإجراءات الجنائية ، وهي التي يجوز لمن قدم الشكوى فيها أن يتنازل عن شكواه ، وأن التنازل فيها لأحد المتهمين يُعد تنازلاً بالنسبة للباقين ، ولكن هذه الجريمة التي دين بها الطاعن تخضع للأحكام المنصوص عليها في المادة 18 مكرراً " أ " ، ولما كان الثابت أن الطاعن لم يكن طرفاً في الصلح الذي تم بين ورثة المجني عليها والمتهم الثاني – وهو ما لا ينازع فيه الطاعن - فإنه لا يستفيد من هذا الصلح ولا شأن له به ، ويضحى ما ينعاه الطاعن على الحكم في هذا الصدد لا محل له . من المقرر أن تغيير اسم الطاعن سهواً بتقرير أسباب الطعن لا يمنع من قبول الطعن شكلًا ، مادام واضحاً للمحكمة اسم الطاعن الحقيقي . (الطعن رقم 18521 لسنة 84 جلسة 2016/02/14)
