Export-Import procedure according to the Irrevocable Documentary Credit method

 Customs Clearance

[1] Concept
- Final confirming process at customs to check if the goods or transaction details are satisfactory to the local trade related regulations and when the customs clearance is completed, local goods are to be transformed to foreign goods in paperless(P/L) that is electronic data interchange(EDI)method clearance.

[2] Customs Clearance Procedure
- The series of process to arrange goods that are to export in a manufacturing plant for the Customs inspection and declare the customs to the storage location and after necessary inspection process, receive export license and release the goods from storage locations and loadin to a vessel. 
(1) Export goods manufacturing or purchasing 
(2) transportation and arrange export goods

1. FCL(Full container Load) Cargo : Sufficient amount of fright to fill 1 container.
2. LCL(Less than Container Load) Cargo : Insufficient fright to fill 1 container.
3. ODCY(Off Dock container Yard) : Container arranging area located in remote area from a wharf .
4. ICD(Inland Container Depot) : Inland clearance station to process to collect container cargos for customs clearance. 
5. CFS(Container Freight Station : Small amount container cargo collecting station) : A designated area to delivery unload goods to a shipper or to deliver the goods to be loaded by a shipping company or a shipper. (Container workshop)

<1> Export freight inland transportation
1. Definition
- To ship the export goods, a shipper go through inland transportation to the shipping port and there are 3 route; a railroad transportation, a public road transportation and marine transportation. 
- Routes may varies depend on the volume of freight, and the kind by a shipper but usually with FCL, there are a public road, a railroad and marine transportation. With LCL, a public road transportation is usual to process a container stowing process at the said CFS.
- FCL freight : Usually transport to the shipping location after a shipper's gate clearance. 
LCL freight : Transport in non-clearance condition and process clearance at the shipping location to ship.

a. LCL Cargo Transportation
- LCL freight: Since the good are insufficient to fill one 20' or 40' container, the freight is transport to the CFS designated by the carrier without container door transportation in Loose Cargo condition. 
- If the export cargo of the owner of the goods is LCL freight : Usually the owner of the goods arrange a to delivery to CY/CFS and in order consolidate cargo from the same area line and to receive transportation benefit a service by forwarder is recommended.

- Taking out the cargo that was taken out from ICD is allowed upon confirming duplicate import permit, duplicate export permit and duplicate bonded transportation permit.
<2> Marine transporting export cargo
1. Definition
- Except a exporter manufactured goods as L/C nominated and load on a vessel Just-in-time, a exporter will request shipping to the said shipping company for the shipping schedule , and transfer the goods to CY location through a transportation company and decare the arrival to the customs for shipping.

<3> Exporting cargo air transportation
- Terminology explanation
1. Air cargo agency
1. A business who conclude a transportation contract in behalf of a carrier

<4> Apparatus of goods
- Principles : A person who wish to export goods must embark the goods at a customs inspection location and declare the location (pre-arrange) on the export declaration application.
- Exception: If there are high-risk information: injustice export or injustice redeem, embark goods at the bonded area designated by a customs officer in case if inspection is necessary in regards to goods character and the company's credibility.
- Load or embark on vessel and air carrier (Requires a customs officer's permission)
1. Goods receiving confirmation by a Surveyor Reports appointed by a official approval organization after goods are shipped. (Ex-Products and Minerals)
2. The goods that needs to be ship before export permission, ommission inspection or possible to receive open inspection on the vessel. 
3. Goods required to maintain its freshness etc, that needs to ship out before export permission.

(3) Export declaration (For the declaration system)
- A person to export goods must declare export goods to the territorial jurisdiction of the said good's manufacturing factory and receive declared certificate.
- Export declaration: Transmit declared data prepared by electronic document through customs system. 
- A person declaring the bottom goods must submit the export declaration in person to a custom officer.
1. Goods subject to receive confirmation by custom officer

.4 In case a shipper or finished goods provider is declaring in person.
- Following export declaration case can be restricted from electronic data exchanging method.

3. If declared without receiving customs process approval in accordance to electronic data exchanging method. 
4. If transmit export declaration using a program that is not registered with the commissioners of customs 
5. If changed a program that was registered with the commissioner of customs
- Declaration goods for simple export
1. For : Non-commercial FOB standard, Non-draft export under fixed amount using air carrier (Applied only with airport customs)
2. Documents : Submit bulk list instead export declaration certificate (Indicate shippers per aircraft, items, quantity, amount, weight etc) (Replace with invoice if a bulk list is not possible)
<1> Declaration method
- Follow each country's law but most countries use 2 methods
1 P/L(paperless) declaration using EDI(electronic data interchange) method
2 Paper declaration--Submit export declaration documents if needed.
<2> Export declaration customs--Customs commissioners controlling goods arranged embarked 
<3> Declaration period
1 Declare after embark goods to export in principle
2 Declaration before good for exports are manufactured. Depends on the completion date, declaration is possible from ~ date.
<4> Declaration preparing method
- Follow each country's law since they are varies.
<5> Revision and correction of export declaration
- If need to change items declared: Submit revision application/statement before the completion arranged date to the commissioners. 
- For inspection omission goods : Revised til license period. Approving manufacture completion date revision of the applicant: At every approving period approve within~date.
- If export declaration using EDI method, and would like to receive any error information of declared information using electronic notification or to revise declared information : Unless a number for declaration is issued, use prior submission number when sending revision information. 
- Point to declare : The period when declaration number is issued from the customs system
<6> Cancelling export declaration acceptance
- In accordance with the related law, the commissioner may cancel acceptance of export declaration for the goods that are not shipped within the given period.
<7> Export declaration and withdrawal or dismissal
- Export declaration withdrawal
1. Required documents : Export declaration withdrawal approval, statement or documents to back up the statement.
2. Importance of withdrawal: When L/C is canceled, and in cases where commissioner determines the declared goods are not appropriate to export.
3. If export earning is confirmed to be paid, a commissioner must no approve export declaration withdrawal. If approved for specific reason, the commissioner must immediately notified to the commissioner of approving authority who issued export license of the fact.
- Export declaration dismissal
1. Importance of dismissal
- If not fulfilled documents attachment request of a commissioner within the specified period. 
- If bonded area carrying in instruction has not been fulfilled when instructed. 
- If goods are not manufactured by the expected completion date and there is no extension for completion date.
- If determine not able to permit export due to violation suspicion of other related customs law.
2. Dismissal Notification : When declaration has been dismissal, the fact must be immediately notified to the person who declared in writing.
<8> Re-issuing process if export declaration certification loss . be robbed (Obey each country's law)
(4) Export inspection (If actual goods inspection is needed: If required to declare)
- Actual goods inspection might be needed for the following reasons. 
(Accepting requisite after confirming the declaration or attach documents)
1. Subject to receive confirmation by a commissioner 
2. Goods subjected for export as strategy goods 
3. re-exporting goods due to a breach of promise or goods understood to be re-export term when the goods were imported 
4. fabricated goods and possibility to invade intellectual property rights 
5. fraud export related to customs duty refundment 
6. If there is high-risk information for unlawful export
<1> The kinds of inspection
1. Official inspection
a. SGS inspection--Execute to prevent smuggling and to manage foreign currency.
b. Export inspection--Exporting country inspects goods for goods quality.
2. buyer's inspection(Private inspection)
- Inspection by importer or another designated person by the importer whether the exporting goods are consistent to the contract.
<2> Customs inspection--Goods subject to inspections are pre-selected through C/S :
cargo selectivity.
<3> pre-shipment inspection(PSI ; Inspect before shipping)
- Depends on the exporting country or importer or country importuning SGS inspects whether the requirements are consistent to the contract or fulfilling other various requisite and issue CRF(clean report findings; Inspection confirmation)
1. Inspection procedure before SGS shipping
a. Receive inspection order from the importing country
- Documents issued from importing country I/L(import licence) or foreign exchange allocation licence.
b. Send RFI(request for information) to the Seller 
c. The seller attach all the necessary documents and present them to SGS 
d. Progress inspection 
e. Send the inspection result and ship goods for export 
f. Issue CRF(clean report of findings).
(5) Customs inspection (In case for license)(Indicate only the title for the difference of the each country's related policy)
- Subject to inspection 
- Inspection omission of the goods subjected for inspection(To operate effective inspection process)
- Inspection method : Determined by exporter's credibility, character of goods, quantity and prices and extraction inspection is the principle.
1. Dispatch inspection: When not assigned as sample inspection or commissioner inspection
2. Sample inspection
3. Inspection by commissioner : Inspection on partial quantity is allowed. Whole or part of goods are allowed to carrying in to the customs inspection location by a commissioner.
(6) Export inspection (If it is license base)
- Export inspection items : Examine declaration documents and declaration screen
1. Export license (E/L) and export declaration (E/P) consistency 
2. Fulfill all the conditions with related law 
3. HS number accuracy for export goods 
4. Other requirements for export goods customs clearance
- Inspection method
- Export declaration in electronic documents : Examine declaration screen for inspection. If necessary to inspect paper documents: Notify paper documents submission using electronic method. 
- If fail to submit paper documents when requested to submit within ~ date from the inspection anticipation date: Considered no intention to declare export declaration and the said declaration data is automatically deleted from customs clearance system.
(7) Export license (In case if license is required)
- Export goods subject to submit paper documents: Issue permit is inspection date is omitted and if subject for inspection, immediately permit upon confirming actual goods consistency to the declared items. 
- Export goods with electronic documents: Inspect electronic screen and issue permit immediately. 
- For expedite customs clearance process, a commissioner may issue permit automatically on 1. export declaration with electronic documents 2. export within certain amount 3. if goods are not subjected for high-risk goods.
- Attach E/P(Export Permit)
- Export permit for export goods on electronic documents can be issued by a customs broker who registered customs broker to the jurisdiction commissioner.
(8) Accepting export declaration (In case declaration is required)
- Upon examining received declaration for wether the details are appropriately prepared to the declaration preparation method, a commissioner accepts declaration 
- If actual goods confirmation is necessary : Upon receiving attached documents and declaration, the declaration is accepted after examining the details.
- For expedite customs clearance process, a commissioner may accept a declaration automatically from cargo selectivity in the following cases.
1. If not subjected to submit documents in accordance to the related regulation }
2. If export declaration amount is within fixed amount and under the amount that a commissioner defines. 
3. If goods are not subjected for high-risk goods with cargo selectivity
- An exception for export customs clearance
- For the non-draft export consign cargo(Exclude re-exporting default goods that are subjected for redeem) that is under certain amount with FOB standard not for public use, a commissioner may regard the declaration as same as bulk list or invoice submission including vessel or shipper of cargo per air craft, items, quantity, amount, weight (Allow only the goods within airport or harbor customs).
(9) Export certificate of declaration issue (With declaration system case)
- If accepting declaration documents that are submitted in person, a commissioner should issue export certificate of declaration to the person declaring.
- If the export certificate of declaration from to the person declaring or the export shipper is not consistent to the electronic documents detail reserved in customs clearance system : In this case, follow electronic documents reserved in the customs clearance system. 
- Preserving documents
- If person declared processed export declaration without document and received electronic notification from a commissioner of the declaration acceptance : Keep export declaration document, invoice and attached documents in declaration number order, and submit the said documents in bulk within said ~ month (i.e.: date, weekly base etc.)order by a commissioner .
(10) Bonded area transportation
(11) Shipping
1. Carrying in the goods accepted for export declaration to the bonded area of shipping port from the export declaration date ~ within date. 
2. Bonded area carrying in extension approval can be issued in accordance with provision.
3. Shipping is not possible unless export declaration is accepted. 
4. Shipping is possible in the following case before declaration acceptance.
- Export declaration accepted goods that are subject for shipping 
- Goods to be directly on board from specially embarked facility: Fluids, Gas, powders etc. 
- Goods to be on board soon ad export goods arrive.

[3] Export customs clearance process for fishes (Only title is indicated here for various laws of each country)
(1) Applied items : Fishes (Live, fresh and only the refrigerated or freeze ones) that are recognized to maintain freshness and exporting from the actual place is inevitable.

[4] Bulk export declaration system (Only index is indicated here for various laws of each country)
(1) Definition : A system allowing shipping the export goods first, declare declaration on the pre-arranged date (Appointing compound number is possible) and declare bulk export declaration to receive export permit. There is actually no customs control in this case.
