قضت محكمة النقض بأن :
" و كان سكوت الضابط عن الإدلاء بأسماء أفراد القوة المصاحبة له لا ينال من سلامة أقواله و كفايتها كدليل في الدعوى ، كما أن خلو دفاتر الأحوال من إثبات قيام الضابط بالمأمورية و عودته منها – و على فرض صحة ذلك – لا ينال من سلامة إجراءات الضبط ، إذ أنه ليس بلازم " .
